Dental Hygiene Month Party – Terms & Conditions

1. Event Description & Attendance

  • The Dental Hygiene Month Party (“Event”) is a free live event open to all attendees.
  • Registration grants you access to the Event at no cost.

  • Attendees may optionally purchase “swag boxes” or donate money to obtain additional entries in Event giveaways. Purchasing swag or donating is not required to attend or to win any giveaways.

  • All giveaway winners will be selected at random. No purchase or donation increases the guarantee of winning beyond additional entries.

2. Giveaway / Entry Conditions

  • Entries earned via purchase or donation will be treated equally in the random drawings with entries earned without purchase, in accordance with fair random selection.

  • Odds of winning depend on the total number of entries received.

  • We reserve the right to verify eligibility, void entries that are fraudulent or non-compliant, and disqualify winners if rules are violated.

3. No Liability; Assumption of Risk

  • Attendance at the Event is at your own risk. The Organizer provides the Event “as‐is” and “as available,” with no warranty as to safety, accuracy, or fitness for any purpose.

  • We are not responsible for technical failures (e.g. streaming interruptions, internet issues), cancellations, postponements, or changes to schedule, venue, or format.

  • By attending, you assume all risk of injury, harm, loss or damage arising from your participation in and travel to/from the Event, whether caused by ordinary negligence.

4. Release and Waiver of Claims

  • To the fullest extent permitted by Illinois law, you release, waive, discharge, and hold harmless State & Lake Marketing, including its employees, agents, contractors (“Released Parties”), from any and all claims, demands, liabilities, causes of action, or damages (including legal fees) arising from or relating to your attendance, participation in, or travel related to the Event—even if caused in whole or in part by ordinary negligence of any Released Party.

  • This release does not apply to gross negligence or willful misconduct (if such is proven under Illinois law).

5. No Liability for Whitney DiFoggio, Sponsors, Merch for Good

  • Whitney DiFoggio (Teeth Talk Girl) is expressly excluded from any liability in connection with the Event; she is not responsible for any claims arising out of or related to the Event.

  • Sponsors, Merch for Good, and any associated third‐party organizations likewise have no liability or responsibility for any claims, losses, or damages arising from the Event, including giveaways.

  • Purchases or donations in “Merch for Good” are considered donations; donors do not obtain any ownership, intellectual property, or claim over Merch for Good, Sponsor materials, or the Oral Cancer Foundation via those donations beyond what is expressly given.

6. Intellectual Property & Use of Materials

  • All trademarks, logos, promotional materials, images, and content produced by the Organizer remain the sole property of State & Lake Marketing.

  • Attendees may not reproduce, redistribute, reuse, or modify any of these materials without express written permission from State & Lake Marketing.
  • Sponsors’ logos or content provided for promotional use may be used only in the manner approved by that sponsor; no repurposing without permission.

7. Indemnification

  • You agree to indemnify, defend, and hold harmless the Released Parties from all claims, damages, losses, liabilities, costs or expenses (including attorneys’ fees) arising out of or related to your participation in the Event, your breach of these Terms & Conditions, or your violation of any rights of another.

8. Dispute Resolution; Arbitration

  • Governing Law: Illinois law shall govern all claims, disputes, interpretations, and enforcement of these Terms & Conditions.
  • Any dispute, controversy, or claim arising out of or relating to these Terms & Conditions, the Event, or any aspect thereof, including whether a party has the right to arbitration, shall be resolved by binding arbitration in Cook County, Illinois under the Illinois Uniform Arbitration Act (710 ILCS 5), or another mutually agreed arbitration provider.

  • The arbitration shall be conducted by a single arbitrator. The arbitrator’s decision shall be final and binding.

  • Each party shall bear their own attorneys’ fees and costs unless the arbitrator rules otherwise.

  • If any part of this arbitration clause is found invalid or unenforceable, the remainder shall continue in full force and effect.

9. Severability; Enforceability

  • If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable under Illinois law, that provision shall be struck, and the remainder shall remain in full force.

  • Exculpatory or limitation of liability provisions are to be construed against the party who drafts them (i.e. us), but we intend them to be as clear, explicit, and concise as required under Illinois law.

10. Entire Agreement

  • These Terms & Conditions constitute the full agreement between you and State & Lake Marketing regarding the Event and supersedes all prior or contemporaneous communications or proposals, whether electronic, oral, or written.

If you agree to attend or participate in the Event (including by registering, entering giveaway, purchasing swag, or donating), you are agreeing to abide by all of the above Terms & Conditions.

By registering for, attending, participating in, purchasing an optional swag box for, donating to, or entering any giveaway connected to the Dental Hygiene Month Party, you agree to these Terms & Conditions and Official Giveaway Rules.

1. Event Description

The Dental Hygiene Month Party is a free live event open to eligible attendees. Registration grants access to the Event at no cost.

Optional swag boxes, upgraded box experiences, merchandise, and donations may be offered before, during, or after the Event. These purchases and donations are optional and are not required to attend the Event, enter any giveaway, or win any prize.

2. Optional Swag Boxes and Upgraded Experiences

Swag boxes and upgraded Event experiences may be made available for purchase in limited quantities.

Purchasing a swag box or upgraded experience may provide guaranteed merchandise, shipping priority, apparel, samples, or other listed benefits.

Swag box purchases and upgraded experiences do not guarantee prize winnings and do not increase the chances of winning any giveaway.

Availability, contents, shipping timing, and estimated values of swag boxes may vary. The Organizer reserves the right to modify box contents, substitute items, or adjust shipping timelines if needed.

3. Donations and Contributions

Donations or contributions connected to the Event are optional.

Donating is not required to attend DHMP, enter any giveaway, receive no-purchase entries, or win any prize.

Unless expressly stated otherwise in writing by a qualified charitable organization, donations or contributions are not represented as tax-deductible.

If a donation campaign identifies a charitable beneficiary, the Organizer will provide the name of the beneficiary and any additional information required by applicable law.

4. Sponsor and Third-Party Products

The Event may include sponsors, vendors, third-party products, samples, offers, links, demonstrations, or educational segments.

Sponsors and third parties are responsible for their own products, services, claims, offers, fulfillment, warranties, and customer support.

The Organizer does not guarantee any sponsor product, third-party offer, product result, or product availability.

Participation by a sponsor does not imply that every sponsor product is endorsed for every attendee or appropriate for every individual situation.

5. Email and SMS Communications

By registering for DHMP, you may receive Event-related emails, including registration confirmation, reminders, schedule updates, giveaway updates, and post-Event information.

SMS reminders may be available as an optional communication method. Consent to receive marketing text messages is not required to attend the Event, purchase a swag box, donate, enter a giveaway, or win a prize.

Message and data rates may apply. Attendees may opt out of SMS messages as instructed in the message.

6. Intellectual Property and Event Materials

All Event names, logos, graphics, copy, images, videos, promotional materials, presentations, and other content produced by the Organizer are owned by or licensed to the Organizer.

Attendees may not reproduce, redistribute, modify, sell, or commercially use Event materials without written permission from the Organizer.

Sponsor logos, trademarks, images, and materials remain the property of their respective owners and may only be used as authorized.

7. Recording, Likeness, and Publicity

The Event may be recorded, photographed, streamed, clipped, repurposed, or shared for promotional, educational, or commercial purposes.

By attending or participating in the Event, you grant the Organizer permission to use your name, submitted comments, chat messages, username, image, voice, likeness, and participation in connection with Event promotion, recap content, sponsor reports, and future marketing, unless prohibited by law.

8. Conduct

Attendees agree not to engage in fraudulent, abusive, disruptive, unlawful, or inappropriate conduct.

The Organizer may remove, block, disqualify, or refuse participation to any attendee who violates these Terms, tampers with the entry process, submits fraudulent entries, abuses the giveaway system, harasses others, or acts in a way that harms the Event or other attendees.

9. Technical Issues and Event Changes

The Organizer is not responsible for technical failures, streaming interruptions, internet issues, platform outages, email delivery issues, SMS delivery issues, payment processor errors, registration system errors, or other events outside the Organizer’s reasonable control.

The Organizer reserves the right to cancel, postpone, modify, suspend, or reschedule the Event or any giveaway if fraud, technical failures, legal issues, sponsor changes, shipping issues, or other circumstances affect the fairness, integrity, operation, or feasibility of the Event.

10. No Purchase Necessary

No purchase, donation, payment, or contribution of any kind is necessary to enter or win any DHMP giveaway.

A purchase, donation, or upgraded box selection does not increase your chances of winning. All eligible giveaway entries are treated equally in random drawings.

Certain upgraded experiences may include instant access to giveaway opportunities. However, registered attendees may obtain the same maximum number of giveaway entries without purchase or donation by following the no-purchase entry method described in the Giveaway Entries section below.

11. Giveaway Eligibility

Unless otherwise stated in a specific giveaway announcement, DHMP giveaways are open to registered attendees who are at least eighteen (18) years old and legal residents of the United States.

Employees, contractors, representatives, agents, vendors, sponsors, and immediate family members of the Organizer may be excluded from certain giveaways at the Organizer’s discretion.

Giveaways are void where prohibited or restricted by law.

12. Giveaway Period

The giveaway period begins on 10-26-26 7:30pm CT and ends on 10-26-26 9:30pm CT, unless otherwise stated by the Organizer.

Entries received before or after the applicable giveaway period may be disqualified.

13. Giveaway Entries

Registered attendees may receive giveaway entries by completing eligible DHMP participation actions during the Giveaway Period. Eligible actions may be announced on the Event website, registration pages, confirmation pages, emails, SMS messages, live Event activities, sponsor experiences, or other official DHMP communications.

Eligible actions may include, but are not limited to:

  • Registering for DHMP
  • Adding the Event to a calendar
  • Completing an Event survey, poll, or product interest form
  • Participating in eligible live Event activities
  • Completing other eligible DHMP actions announced by the Organizer during the Giveaway Period

The Organizer may add, modify, or limit eligible entry opportunities during the Giveaway Period, provided that no purchase, donation, or payment is required to obtain the maximum number of giveaway entries.

No purchase, donation, or payment of any kind is required to enter or win. A purchase or donation will not increase your chances of winning.

Registered DHMP attendees may also request additional no-purchase giveaway entries by submitting a written request by email to hello@dentalhygienemonthparty.com with the subject line “DHMP Giveaway Entry”

The request must include the attendee’s full name, the email address used to register for DHMP, and a statement requesting additional giveaway entries.

Eligible requests must be received during the Giveaway Period. Entries received through this method will be treated the same as entries received through any other eligible entry method.

Maximum total entries per person: five (5), regardless of entry method, purchase status, donation status, or upgrade status.

14. Random Winner Selection

All giveaway winners will be selected at random from eligible entries received during the applicable giveaway period.

Odds of winning depend on the total number of eligible entries received for each giveaway.

Purchasing a swag box, making a donation, or selecting an upgraded experience does not increase the odds associated with any individual entry.

15. Winner Notification and Prize Claim

Potential winners may be notified by email, SMS, live Event announcement, or another method determined by the Organizer.

Potential winners may be required to respond within a stated time period to claim a prize. If a potential winner does not respond within the required time, is found to be ineligible, or does not comply with these Terms and Rules, the Organizer may select an alternate winner at random.

The Organizer is not responsible for missed messages, incorrect contact information, spam filtering, technical issues, or failure to receive a prize notification.

16. Prizes

Prize descriptions, approximate retail values, and any prize-specific limitations may be announced before or during the Event.

Prizes are non-transferable and may not be substituted or exchanged for cash unless the Organizer chooses to do so at its sole discretion.

The Organizer reserves the right to substitute a prize of equal or greater value if a listed prize becomes unavailable.

Winners are responsible for any taxes, fees, costs, or expenses associated with accepting or using a prize, unless otherwise stated.

17. Release of Liability

To the fullest extent permitted by law, by attending, registering for, purchasing, donating to, entering, or participating in the Event or any giveaway, you release and hold harmless State & Lake Marketing, Teeth Talk Girl, Whitney DiFoggio, Merch for Good, sponsors, vendors, fulfillment partners, payment processors, contractors, affiliates, officers, employees, agents, and representatives from and against any and all claims, liabilities, losses, damages, costs, or expenses arising out of or relating to the Event, giveaways, prizes, swag boxes, donations, third-party products, technical issues, or your participation.

This release does not apply to claims that cannot be released under applicable law.

18. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, damages, losses, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to your participation in the Event, your violation of these Terms, your misuse of Event materials, your violation of another person’s rights, or your fraudulent or improper conduct.

19. Limitation of Liability

To the fullest extent permitted by law, the Event, giveaways, content, materials, swag boxes, and related experiences are provided “as is” and “as available,” without warranties of any kind.

The Organizer is not liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to the Event, giveaways, prizes, swag boxes, donations, sponsor products, or third-party services.

20. Dispute Resolution and Governing Law

These Terms and any disputes arising out of or related to the Event shall be governed by the laws of the State of Illinois, without regard to conflict-of-law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, the Event, any giveaway, any purchase, or any donation shall be resolved by binding arbitration in Cook County, Illinois, unless prohibited by applicable law.

The arbitration shall be conducted by a single arbitrator under the Illinois Uniform Arbitration Act or another mutually agreed arbitration provider. The arbitrator’s decision shall be final and binding.

Each party shall bear its own attorneys’ fees and costs unless the arbitrator determines otherwise or applicable law requires otherwise.

21. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be modified or removed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

22. Entire Agreement

These Terms and Conditions and Official Giveaway Rules constitute the full agreement between you and State & Lake Marketing regarding the Event and supersede all prior or contemporaneous communications, whether electronic, oral, or written.

By registering for, attending, purchasing, donating to, entering, or participating in DHMP, you agree to these Terms and Conditions and Official Giveaway Rules.
